The Human Rights Act is an act of the Legislative Assembly of Prince Edward Island relating to human rights in provincial law.

Provisions

Protected grounds

The legislation prohibits discrimination on the basis of political belief, association, activity, convictions, affiliation and opinion.[1] The act prohibits discrimination on the basis of sex, gender, gender identity and gender expression.[2]

Included scenarios

Previously an employee could waive their right to make a under the legislation and the provincial Employment Standards Act, but this was removed in 2021.[3]

Application

In 2022, it was found that waiting four years for the performance of an investigation was "well outside the contemplation" of the legislature, as it was expressed in the act.[4]

Implementation

Complaints under the act are made to the PEI Human Rights Commission.[5]
