The Human Rights Act is an act of the Nova Scotia House of Assembly which defines the human rights of individuals within provincial law.
Provisions
Protected grounds
The act prohibits discrimination based on disability.[1] The act prohibits discrimination against individuals on the basis of race or colour.[2]
Included sectors
The act includes prohibitions on discrimination the provincial Department of Justice against prisoners.[1] Discrimination by retailers and other companies towards customers is prohibited under the legislation.[2]
Implementation
The act is enforced by the Nova Scotia Human Rights Commission.[3]
Application
In 2018, the provincial government was found to be in violation of the act through failing to discriminate against wheelchair users due to failing to enforce a regulations requiring restaruants to provide accessible bathrooms.[4] In 2021, Halifax Regional Police were found to be in violation of the act in relation to a case where a Black man was ticketed for jaywalking.[5]
